§ 1. General provisions

§ 2. Definitions
- Buyer – a natural person, legal person or organizational unit making a purchase in the Store.
- Goods – products available in the Online Store.
- Sales Agreement – an agreement concluded between the Buyer and the Seller under the terms and conditions specified in the Regulations.
- User Account – an individual account created by the Buyer on the Store’s website, enabling access to the Store’s services.
- Shop – a sales platform available on the Internet that allows users to browse the product range, place orders and make payments remotely, without having to be physically present at a retail premises. The shop sells to consumers and entrepreneurs, offering a variety of delivery and payment methods.
- Seller – a natural person, legal person or organizational unit offering goods or services for sale via an online store.
§ 3. Rules for using the store
- Each Buyer should familiarize themselves with the regulations of the store before starting to use it.
- To place an order you must:
- registering a user account or placing an order without registration,
- providing data necessary to complete the order.
- RoverVans products are sold through the store.
- By placing an order, the Buyer confirms that he or she has read the Regulations and accepts their terms.
- The store's products are new and free from defects.
- Products are covered by a one-year warranty unless the item description and documentation states otherwise.
- Commercial information posted on the website does not constitute a commercial offer within the meaning of the Civil Code, but is an invitation to submit offers.
§ 4. Order fulfillment and shipping
- Unless the current offer states otherwise, the cost of delivering and collecting the item shall be borne by the Buyer.
- The condition for concluding a contract is that the Buyer sends an offer to purchase goods using the form on the store's website, e-mail or telephone and its acceptance by the online store.
- The condition for the release of goods is payment for the goods and shipment.
- The price is binding on both parties at the time of placing the order.
- The current order completion date is provided when placing the order.
- Order fulfillment begins after payment has been received (in the case of payment in advance).
- Goods prices are net prices and do not include VAT.
- The buyer can choose one of the following payment methods:
- bank transfer,
- payment by payment or credit card,
- online payment via a payment system [e.g. PayU, Przelewy24].
§ 5. Delivery
- Within Poland, transport services are provided by GLS, while international shipments are handled by Poczta Polska Global Express or UPS.
- The place of delivery is the place indicated by the Buyer in the order.
- Personal data is protected and processed for the purpose, time and scope specified in the Privacy Policy available on the rovervans.com website.
- The cost of delivery, unless it is free, is borne by the Buyer. Information on the cost is calculated in the shopping cart based on the quantity and type of products added and the current price lists of the companies indicated in point 1.
§ 6. Right of withdrawal
- Based on the Buyer's Rights Act of 30 May 2014, a Buyer who has concluded a distance or off-premises contract may withdraw from it within 14 days without giving a reason and without incurring costs. To meet the deadline, it is sufficient to send a statement of withdrawal from the contract before it expires.
- The Buyer may withdraw from the contract by submitting a declaration of withdrawal from the contract to the Seller. The declaration can be submitted on a form, the template of which can be downloaded from the rovervans.com website in the returns and complaints tab.
- The Buyer returns the goods to the Store within 14 days of submitting the declaration of withdrawal from the contract. The returned goods should be complete.
- The Seller shall immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract, return all payments made by the Buyer. The Seller shall return the payment using the same method
payment method used by the Buyer, unless the Buyer expressly agreed to another method
return. The Seller may withhold the return of payments received from the Buyer
until the goods returned by the Buyer are received - The cost of shipping in the event of withdrawal from the contract is borne by the Buyer.
- Entrepreneurs making purchases for purposes unrelated to their business activities have the right to withdraw from the contract within 14 days under the terms specified in paragraph 4.
§ 7. Complaints

The Store shall be liable to the Buyer for any lack of conformity of the Product with the Sales Agreement from the moment it is delivered to the Buyer and is disclosed within two years from that date.

The Store shall not be liable for the lack of conformity of the Product with the Sales Agreement if the Buyer, at the latest at the time of conclusion of the Agreement, was informed by the Store of the fact that a specific feature of the Product deviates from the requirements of its conformity with the Agreement and accepted in writing (e.g. by e-mail) the lack of a specific feature of the Product.

If the Product is inconsistent with the Sales Agreement, the Buyer has the right to have the Product repaired or replaced.

The Store may replace the Product when the Buyer requests a repair, or the Store may repair when the Buyer requests a replacement of the Product, if bringing the Product into compliance with the Sales Agreement in the manner chosen by the Buyer is impossible and involves excessive costs for the Store. If both of the above issues cannot be met by the Store, the Buyer may submit a declaration of a price reduction or withdrawal from the Agreement.

The Store will repair or replace the Product within 14 days of delivery of the Product to the Store.

The costs of repair or replacement of the Product are borne by the Store. The Buyer will provide the possibility of collection of the Product by the Store, which is done at the Store's expense.

The Store may not accept the Consumer's declaration of withdrawal from the Sales Agreement if it proves that the lack of conformity of the Goods with the Sales Agreement is immaterial.

Any complaints related to the performance of the Sales Agreement may be submitted by the Buyer via e-mail or in writing to the Store's address. The Store will respond to the complaint within 14 days from the date of delivery of the product to the Store.
§ 8. Dispute resolution
- In the event of the Buyer's dissatisfaction with the service or in connection with the omission of actions to which the Seller is obliged to take, the Buyer is in each case entitled to initiate mediation, use the online consumer dispute resolution system : http://ec.europa.eu/consumers/odr or take legal action before a common court competent to resolve the case.
§ 9. Dispute resolution

The administrator of the Buyers’ personal data is ROVERVANS LIMITED LIABILITY COMPANY.

Buyers’ personal data are processed solely for the purpose of order fulfillment and – with the Buyer’s consent – for the purpose of sending the newsletter.

The Buyer has the right to access their personal data, correct them and request their deletion.
§ 10. Final Provision

These Regulations are available free of charge on the Store's website and can be downloaded and saved by the Buyer.

In matters not regulated by the Regulations, the provisions of Polish law shall apply, including the Civil Code and the Consumer Rights Act.

The Seller reserves the right to change the Regulations. Changes will be published on the Store's website and will come into effect on the date of publication.
